TERMS & CONDITIONS

These Terms and Conditions (“Agreement”) apply to all quotations, services, and works performed by Treeco Arboriculture Pty Ltd (“Treeco”).
By accepting a quotation, the Client acknowledges and agrees to be bound by the following terms and conditions.
1. Quote Validity
1.1 All quotations issued by Treeco are valid for 30 calendar days from the date of issuance, unless otherwise specified in writing.
1.2 After this period, Treeco reserves the right to revise the quotation based on changes in market conditions or site-specific factors.
2. Acceptance of Quote
2.1 A written acceptance of the quotation, via email or online platform, is required to initiate the scheduling of any work.
2.2 By accepting the quotation, the Client agrees to these Terms and Conditions and affirms their understanding and consent to the scope of work as outlined.
3. Access to Site
3.1 The Client is responsible for ensuring clear, safe, and unobstructed access to the work site for Treeco’s personnel, vehicles, and equipment.
3.2 Any access restrictions or hazards must be disclosed to Treeco in writing prior to the commencement of works. Failure to do so may result in delays or additional charges.
4. Underground & Overhead Services
4.1 The Client is responsible for identifying and notifying Treeco of any underground or overhead services (e.g., water, gas, electricity, telecommunications, irrigation systems) on or near the work site.
4.2 Treeco will not be liable for damage to any undisclosed services.
5. Scope of Work
5.1 The work will be carried out strictly as described in the quotation. Any changes or additional work outside the quoted scope must be mutually agreed upon in writing and may incur additional costs.
5.2 Treeco will provide the Client with a revised quotation for any additional work.
6. Tree Condition & Hidden Defects
6.1 Trees may have hidden defects, decay, or other hazards that are not visible during the initial inspection.
6.2 If such issues are discovered during the work, Treeco will inform the Client and provide a revised scope of work and associated costs for any necessary additional work or safety measures.
7. Weather & Safety
7.1 Treeco reserves the right to reschedule work due to unsafe weather conditions (e.g., high winds, storms, extreme temperatures) in order to ensure the safety of personnel, property, and the environment.
7.2 Any delay due to weather conditions will not result in penalties or liabilities for Treeco.
8. Waste Removal
8.1 Disposal of timber, branches, and other debris will be included or excluded as specified in the quotation.
8.2 If not included, the Client is responsible for arranging disposal of the debris, and it will remain on-site unless other arrangements are made.
9. Stump Grinding
9.1 Stump grinding will leave a mixture of wood chips and soil unless the Client has specifically requested removal of the material.
9.2 The Client acknowledges that underground obstacles (e.g., rocks, metal, concrete) may limit the depth of grinding, and Treeco will not be liable for any limitations caused by these obstacles.
10. Damage to Lawns & Garden Areas
10.1 While care is taken to minimise disturbance, the Client acknowledges that minor damage to lawns, gardens, or surrounding areas may occur as a result of equipment or falling debris.
10.2 Treeco will not be held responsible for such minor damage unless caused by gross negligence.
11. Payment Terms
11.1 Unless otherwise agreed, payment for services is due within 7 calendar days of the date of the invoice.
11.2 For quotations exceeding $8,000, a 50% deposit is required prior to the commencement of work. The remaining balance is due upon completion of the work.
11.3 Any late payments will incur interest equal to 5% of the original invoice amount for every 30 days that the invoice remains outstanding.
12. Council or Regulatory Approvals
12.1 The Client is responsible for ensuring any necessary permits, approvals, or licences from the relevant council or regulatory body are obtained before work commences.
12.2 Treeco will not be held liable for delays or penalties due to the Client's failure to secure these approvals.
13. Insurance
13.1 Treeco maintains public liability insurance to cover liabilities arising from its arboricultural operations.
13.2 A certificate of insurance will be provided upon request.
14. Photographs & Documentation
14.1 Treeco may take photographs of the site before, during, and after work for operational records or promotional purposes unless the Client requests otherwise in writing.
14.2 The Client may request that photographs or documentation not be published or used for promotional purposes.
15. Litigation Costs
15.1 In the event of a dispute that results in legal proceedings, the Client acknowledges that Treeco will make reasonable efforts to resolve any issues amicably and avoid the need for litigation. However, if the matter proceeds to small claims court or similar legal action, the Client may be required to pay reasonable legal fees, court costs, or other expenses incurred by Treeco in the course of enforcing this Agreement.
15.2 Treeco will take all steps necessary to keep costs manageable and will only pursue legal action when absolutely necessary. Any attempt to resolve the dispute amicably will be made in good faith.
